THIS LICENSE AGREEMENT IS A LEGAL AND BINDING AGREEMENT (“AGREEMENT”) BETWEEN YOU ("LICENSEE") AND DIGITAL PROPERTY LIMITED (“Everypixel”) THIS LICENSE AGREEMENT APPLIES TO LICENSES ISSUED ONLINE (THE “AGREEMENT”).
By downloading content from Everypixel.com, you accept the terms of this agreement.
Subject to the terms of this License Agreement, Everypixel grants Licensee a perpetual, worldwide, non-transferable, non-exclusive right, which you may use in non- commercial purpose:
on websites, blog posts, web and mobile applications;
in promotional and advertising purposes in magazines, newspapers and books;
in advertising and promotional printed projects, including corporate printed materials, brochures, handouts, leaflets, posters, presentations, calendars, commercials, catalogues, brochures, promotional greeting cards and promotional postcards and other reproductions for personal or business use (providing they are not for resale, license or for other distribution);
as prints, posters, single hand painted reproduction, printed reproduction on canvas or other material and other reproductions for personal, non-commercial use and displayed as a design element of any indoor object. You have right to edit, arrange or otherwise remake the Images (right to edit), so as a right to be a copyright holder of art-works (videos, slide desks, templates, design layouts, made with Images) which results such remaking, change or improvement of the Images Perpetual, meaning there is no expiration or end date on your rights to use the content.
in video, video presentations, reportages and movies irrespective of the dimensions of the audience
ATTENTION: Every time when you are using content, you must include following mention of Everypixel and author: “Everypixel.com/Author’s Member Name.”
use content in a pornographic, defamatory or other unlawful manner.
use content in any way that allows others to download: sub-license, re-sell, rent, lend, assign, gift or otherwise transfer or distribute for profit or free of charge the Images as a standalone digital file to third parts
use content as part of a trademark, design mark, tradename, business name, service mark, or logo.
use the Images in any items for resale or other distribution of “on demand” or other distribution for profit (digital files, postcards, posters and calendars, digital templates, wallpaper, souvenirs or other similar items);
display the Images as a stand-alone digital file at the network server, use or display the Images in an electronic format that enables it to be downloaded, distributed or shared in any peer-to-peer or similar file sharing arrangement, or incorporate the Images in any product in the way that permits the recipient to extract the licensed Images for use separate and apart from the product and free of charge.
ATTENTION: You may not falsely represent that you are the original creator of a work that is made up largely of licensed content. For instance, you cannot create a painting or deviation/manipulation based on licensed content and claim that you are the author.
Everypixel reserves the right to automatically terminate or revoke the License contained in this Agreement without notice if Licensee fails to comply with any provision of this Agreement. In addition, Everypixel may withdraw the content based on a potential or actual legal claim. Upon termination or withdrawal, Licensee must immediately discontinue all future use of the Image, delete the Image and all copies from all magnetic/electronic media and destroy all other copies in its possession or control. Everypixel may replace the Image with an alternate Image(s) upon its discretion.
If one or more of the provisions contained in the Agreement is found to be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not be affected. Such provisions shall be reformed only to the extent to make it enforceable.
